\u00a01.1 These General Terms and Conditions (hereinafter referred to as \u201cGTC\u201d) of Outbounce GmbH (hereinafter referred to as the \u201cSeller\u201d) apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter referred to as the \u201cCustomer\u201d) concludes with the Seller in relation to the goods presented by the Seller on the online trading platform Amazon.de (hereinafter referred to as \u201cAmazon\u201d). The inclusion of the Customer\u2019s own terms and conditions is hereby rejected, unless otherwise agreed.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\u00a02.1 The product descriptions presented by the Seller on Amazon do not constitute binding offers on the part of the Seller but serve for the submission of a binding offer by the Customer.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

2.2 The Customer can submit the offer via the shopping cart system integrated on Amazon or \u2013 if available for the respective product \u2013 via the 1-Click\u00ae purchase function.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

2.2.1 In the case of an order via the shopping cart system, the Customer submits a legally binding contractual offer for the goods in the shopping cart by clicking the \u201cBuy Now\u201d button after completing the technical steps specified by Amazon in the final step of the ordering process.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

2.2.2 In the case of an order via the 1-Click\u00ae purchase function, the Customer submits a legally binding contractual offer for the selected quantity of goods on the respective product detail page by clicking the \u201cBuy now with 1-Click\u00ae\u201d button after activating this function in their Amazon user account and completing the technical steps provided by Amazon.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

2.3 Immediately after submitting their order, the Customer receives a confirmation email from Amazon indicating that the Seller has received the offer. The Seller can accept the Customer\u2019s offer within five days:<\/span><\/p>

  • By sending a written order confirmation or an order confirmation in text form (fax or email) to the Customer, or by having such confirmation sent by Amazon (the receipt of the confirmation by the Customer is decisive).<\/li>
  • By delivering the ordered goods to the Customer or having them delivered by Amazon (receipt of the goods by the Customer is decisive).<\/li>
  • By requesting payment from the Customer after submitting the order or having Amazon request payment.<\/li>
  • If direct debit payment is offered and chosen by the Customer, by collecting the total amount from the Customer\u2019s bank account or having Amazon collect it (the time at which the account is charged is decisive).<\/li><\/ul>

    If several of the aforementioned alternatives apply, the contract is concluded at the time when one of the alternatives occurs first. The deadline for acceptance of the offer begins on the day following the submission of the offer by the Customer and ends at the end of the fifth day following that day. If the Seller does not accept the Customer\u2019s offer within this period, the offer is considered rejected and the Customer is no longer bound by their declaration of intent.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    2.4 The contract text is stored by the Seller after the conclusion of the contract and sent to the Customer in text form (e.g., email, fax, or letter) after the order. No further access to the contract text is provided by the Seller. In addition, the order details are archived by Amazon and can be accessed free of charge by the Customer via their password-protected Amazon user account.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    2.5 In the case of an order via Amazon\u2019s shopping cart system, the Customer can identify input errors before the final submission of the order by carefully reading the information displayed on the screen and correct them using the usual keyboard and mouse functions. In addition, all entries are displayed once again in a confirmation window before the final submission of the order and can also be corrected there using the usual keyboard and mouse functions. In the case of an order via the 1-Click\u00ae purchase function, the order process is completed once the \u201cBuy now with 1-Click\u00ae\u201d button is clicked.     4.2 For deliveries to countries outside the European Union, additional costs may arise in individual cases, which the Seller is not responsible for and which are to be borne by the Customer. These include, for example, costs for money transfers by credit institutions (e.g., transfer fees, exchange rate fees) or import duties or taxes (e.g., customs duties).     5.2 If the delivery of the goods fails for reasons attributable to the Customer, the Customer must bear the reasonable costs incurred by the Seller as a result. This does not apply to the cost of sending the goods if the Customer effectively exercises their right of withdrawal. For return shipping costs, the regulations in the Seller\u2019s cancellation policy apply.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

    5.3 The Seller reserves the right to withdraw from the contract in case of incorrect or improper self-supply. The Seller will make all reasonable efforts to procure the goods.
