1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) of Outbounce GmbH (hereinafter referred to as the “Seller”) apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter referred to as the “Customer”) concludes with the Seller in relation to the goods presented by the Seller on the online trading platform Amazon.de (hereinafter referred to as “Amazon”). The inclusion of the Customer’s own terms and conditions is hereby rejected, unless otherwise agreed.
1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity.
1.3 An entrepreneur within the meaning of these GTC is a natural or legal person or a legal partnership who, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity.
2.1 The product descriptions presented by the Seller on Amazon do not constitute binding offers on the part of the Seller but serve for the submission of a binding offer by the Customer.
2.2 The Customer can submit the offer via the shopping cart system integrated on Amazon or – if available for the respective product – via the 1-Click® purchase function.
2.2.1 In the case of an order via the shopping cart system, the Customer submits a legally binding contractual offer for the goods in the shopping cart by clicking the “Buy Now” button after completing the technical steps specified by Amazon in the final step of the ordering process.
2.2.2 In the case of an order via the 1-Click® purchase function, the Customer submits a legally binding contractual offer for the selected quantity of goods on the respective product detail page by clicking the “Buy now with 1-Click®” button after activating this function in their Amazon user account and completing the technical steps provided by Amazon.
2.3 Immediately after submitting their order, the Customer receives a confirmation email from Amazon indicating that the Seller has received the offer. The Seller can accept the Customer’s offer within five days:
If several of the aforementioned alternatives apply, the contract is concluded at the time when one of the alternatives occurs first. The deadline for acceptance of the offer begins on the day following the submission of the offer by the Customer and ends at the end of the fifth day following that day. If the Seller does not accept the Customer’s offer within this period, the offer is considered rejected and the Customer is no longer bound by their declaration of intent.
2.4 The contract text is stored by the Seller after the conclusion of the contract and sent to the Customer in text form (e.g., email, fax, or letter) after the order. No further access to the contract text is provided by the Seller. In addition, the order details are archived by Amazon and can be accessed free of charge by the Customer via their password-protected Amazon user account.
2.5 In the case of an order via Amazon’s shopping cart system, the Customer can identify input errors before the final submission of the order by carefully reading the information displayed on the screen and correct them using the usual keyboard and mouse functions. In addition, all entries are displayed once again in a confirmation window before the final submission of the order and can also be corrected there using the usual keyboard and mouse functions. In the case of an order via the 1-Click® purchase function, the order process is completed once the “Buy now with 1-Click®” button is clicked. Corrections to input errors are no longer possible after clicking this button.
2.6 The contract language is German.
3.1 Consumers are generally entitled to a right of withdrawal.
3.2 Further information on the right of withdrawal can be found in the Seller’s cancellation policy.
4.1 Unless otherwise stated in the Seller’s product description, the stated prices are total prices that include statutory VAT. Any additional delivery and shipping costs are specified separately in the respective product description.
4.2 For deliveries to countries outside the European Union, additional costs may arise in individual cases, which the Seller is not responsible for and which are to be borne by the Customer. These include, for example, costs for money transfers by credit institutions (e.g., transfer fees, exchange rate fees) or import duties or taxes (e.g., customs duties). Such costs may also arise in relation to money transfers if the delivery is not to a country outside the EU, but the Customer makes the payment from a country outside the EU.
4.3 Payment processing is handled by the payment service provider Amazon Payments Europe s.c.a., 38 avenue John F. Kennedy, L-1855 Luxembourg, who has been commissioned by the Seller for payment handling.
5.1 If the Seller offers shipping, delivery is made within the delivery area specified by the Seller to the delivery address provided by the Customer, unless otherwise agreed. The delivery address stored by the Customer on Amazon is decisive for processing the transaction.
5.2 If the delivery of the goods fails for reasons attributable to the Customer, the Customer must bear the reasonable costs incurred by the Seller as a result. This does not apply to the cost of sending the goods if the Customer effectively exercises their right of withdrawal. For return shipping costs, the regulations in the Seller’s cancellation policy apply.
5.3 The Seller reserves the right to withdraw from the contract in case of incorrect or improper self-supply. This applies only if the non-delivery is not the fault of the Seller and the Seller has concluded a specific covering transaction with the supplier with due diligence. The Seller will make all reasonable efforts to procure the goods. In the event of unavailability or only partial availability of the goods, the Customer will be informed immediately and any consideration already paid will be refunded without delay.
If the Seller makes advance payment, they retain ownership of the delivered goods until the purchase price owed has been paid in full.
7.1 If the purchased item is defective, the statutory provisions of liability for defects shall apply.
7.2 If the Customer acts as a consumer, they are requested to report any goods with obvious transport damage to the delivery agent and inform the Seller. Failure to do so has no effect on the Customer’s statutory or contractual warranty rights.
The Seller is neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
